Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of Clarento, a digital asset management application provided by Norda ("we", "us", "our"). By installing or using Clarento, you agree to these Terms.
Clarento is a Forge application that runs within Atlassian Jira and Confluence. Your use of Atlassian products is also governed by Atlassian's Terms.
2. Description of Service
Clarento provides:
- Digital asset upload, storage, and management
- Collections for organizing and sharing assets
- Brand portal for publishing brand guidelines
- AI-powered auto-tagging and visual search
- REST API for external integrations
- Webhook support for automated asset registration
3. Account and Access
- You must have a valid Atlassian Cloud subscription to use Clarento
- Site administrators install Clarento and manage access for their organization
- You are responsible for maintaining the security of your Atlassian account and Supabase credentials
- You must not share API keys or webhook secrets with unauthorized parties
4. Acceptable Use
You agree not to use Clarento to:
- Upload, store, or distribute content that is illegal, harmful, or infringes on intellectual property rights
- Attempt to bypass security measures, authentication, or access controls
- Reverse engineer, decompile, or disassemble the application
- Use the service to send spam, malware, or conduct phishing
- Exceed reasonable usage limits or abuse the API in a way that degrades service for others
- Upload content that violates applicable data protection regulations
We reserve the right to suspend or terminate access for violations of these terms.
5. Your Content
- Ownership — you retain all rights to the assets, metadata, and content you upload to Clarento
- License — by uploading content, you grant Norda a limited license to process, store, and display your content solely to provide the Clarento service
- Shared content — when you share collections or brand portals publicly, the content becomes accessible to anyone with the link. You are responsible for ensuring you have the right to share such content.
- AI processing — when AI features are enabled, uploaded images are sent to Anthropic for analysis. You confirm you have the right to process this content through third-party AI services.
6. Storage and Data
- Asset files and metadata are stored in your own Supabase project. You are responsible for your Supabase account, billing, and data management.
- Norda does not independently store copies of your asset files.
- App configuration is stored in Atlassian Forge KVS and governed by Atlassian's data policies.

7. Service Availability
- We target 99.9% monthly uptime for the Clarento application
- Service availability depends on Atlassian Forge and Supabase platform availability, which are outside our control
- Planned maintenance is performed during scheduled windows (Saturdays 02:00–06:00 UTC)

9. Fees and Payment
- Clarento pricing is published on the Atlassian Marketplace
- Payment is processed through Atlassian's Marketplace billing
- Norda does not directly collect payment information from customers
- Free tiers or trial periods may be offered and can be modified or discontinued with 30 days' notice
10. Intellectual Property
- Clarento, including its code, design, documentation, and branding, is the intellectual property of Norda
- You may not copy, modify, or distribute the application or its components
- The Clarento name, logo, and related marks are trademarks of Norda
- Open-source components used in Clarento are licensed under their respective terms
11. Limitation of Liability
To the maximum extent permitted by law:
- Norda's total liability for any claims arising from your use of Clarento is limited to the fees paid by you in the 12 months preceding the claim
- Norda is not liable for indirect, incidental, special, consequential, or punitive damages
- Norda is not liable for loss of data resulting from Supabase or Atlassian platform failures
- Norda is not liable for content uploaded by users or shared through public links
12. Indemnification
You agree to indemnify and hold Norda harmless from any claims, damages, or expenses arising from:
- Your use of Clarento in violation of these Terms
- Content you upload, store, or share through Clarento
- Your violation of any applicable law or third-party rights
13. Termination
- You may stop using Clarento at any time by uninstalling the app from your Atlassian site
- Upon uninstallation, Forge KVS data is automatically deleted by Atlassian
- Supabase-hosted data remains in your own Supabase project
- We may suspend or terminate access for violations of these Terms with reasonable notice
- Sections 5, 11, 12, and 14 survive termination
14. Governing Law
These Terms are governed by the laws of Iceland. Any disputes arising from these Terms shall be resolved in the courts of Reykjavík, Iceland.
15. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes by:
- Posting a notice in the Clarento application
- Updating the "Effective Date" at the top of this page
Continued use of Clarento after 30 days' notice constitutes acceptance of the updated terms. Material changes that reduce your rights will not apply retroactively.
